These Terms of Service ("Terms") govern your use of the Antatah Arogyam clinic management platform ("Service"), operated from Vani, Nashik, Maharashtra, India. By creating an account, ticking the acceptance box, or using the Service, you ("Clinic") agree to these Terms.
The Digital Personal Data Protection Act, 2023 governs personal data of individuals in India. The Clinic is the Data Fiduciary (controller) for all patient data it enters. Antatah Arogyam acts solely as a Data Processor, processing patient data only on the Clinic's documented instructions to provide the Service. The Clinic is responsible for obtaining valid, informed patient consent before entering personal or health data.
The Clinic agrees to: obtain patient consent at registration; enter accurate data; grant staff access only on a need-to-know basis; keep login PINs confidential; and use the Service only for lawful clinical and billing purposes. The Clinic must not upload data it has no lawful basis to process.
The Clinic must honour patient rights under the DPDP Act — access, correction, erasure (subject to legal retention), and withdrawal of consent — and respond to such requests within 30 days. Antatah Arogyam will provide the tools needed for the Clinic to fulfil these requests.
Data is encrypted in transit (TLS 1.3) and at rest, access is role-based, and all access events are logged in an immutable audit trail. In the event of a personal data breach, Antatah Arogyam will notify the affected Clinic without undue delay so the Clinic can meet its own notification duties to the Data Protection Board and data principals.
The Service is offered on monthly subscription and, for eligible early clinics, one-time lifetime plans. Lifetime plans are limited in number, are non-transferable, and cover the tier's patient and clinic limits. Fees are exclusive of applicable taxes. Payments are processed by our payment partner; we do not store card details.
Patient medical records are retained for a minimum of 3 years (Indian Medical Records Rules, 2016) and billing records for 7 years (GST). On termination, the Clinic may export its data within 30 days, after which data may be deleted subject to statutory retention.
You may not attempt to breach security, reverse-engineer the Service, resell access, or use the Service to store data unrelated to clinical operations. We may suspend accounts that violate these Terms or applicable law.
The Service is provided on an "as is" basis. To the extent permitted by law, Antatah Arogyam's aggregate liability is limited to the fees paid in the 12 months preceding the claim. We are not liable for the Clinic's failure to obtain patient consent or to meet its own obligations as Data Fiduciary.
